As a PM that I (briefly) worked with used to always say, "legality is subjective".
I've had team members make complaints to HR, have HR realize that what the employee is reporting is, in their words, "110% illegal", and not be able to do a thing about it.
The problem was that because the reported behaviour was illegal, the only thing HR could do was recommend that the employee report it to the police. They didn't, or couldn't, even file an internal complaint, other than "referred to legal authorities"
The employees realized that this meant that if they *did* report it to the police, it would just be a he said/she said situation, and the company wouldn't back him up. So, the employee either shut up, or left the company, and the illegal activity continued.
Eventually, years later, there would be an audit, and the auditors would be stunned by the sheer amount of open illegality that been going on. As one auditor put it to me, the company was doing "glow in the dark" illegal activity, and yet the company directors claimed ignorance of it.
